General terms and conditions of Paragliding Gstaad Switzerland Fabrice Bielmann:

1. Establishment of the contract
Registration orally, via telephone, in writing or via booking on the website for the activities offered by Paragliding Gstaad Switzerland Fabrice Bielmann (hereafter referred to as “the organizer”) shall constitute the formation of a binding contract between the customer and the organiser. If you register other participants, you are responsible for their contractual obligations in the same manner as you are responsible for your own contractual obligations. The contractual provisions and these general conditions of contract are applicable to all participants. We therefore advise you to read the general conditions below very carefully and to pass them on to the other participants. In the event of discrepancies between the French, German, and English versions, the French version of these general conditions shall prevail.
 
 
2. Subject matter of the contract
The organizer agrees to perform the service agreed to with the customer within the scope of the offer and/or the order confirmation. By agreement with the organizer, extensions of services may be taken into account. Any additional costs are the responsibility of the customer.
 
 
3. Prices
The prices are in Swiss francs and per person. Any payment in other currency will be calculated according to the daily rate.
 
 
4. Cancellation or modification of the service by the customer
In the event of partial or complete cancellation, the following cancellation fees are billed to the customer, for each participant cancelled:
 
For individuals and groups of up to 7 people:
  • Between 3 and 9 days before the activity: the cancellation fee is 50% of the flight price, for each person cancelling.
  • Less than 48 hours before the activity or in case of a no-show: the cancellation fee is 100% of the flight price, for each person cancelling or not present.
For group reservations of 8 people or more:
  • Between 10 and 20 days before the activity: the cancellation fee is 25% of the flight price, for each person cancelling.
  • Between 3 and 9 days before the activity: the cancellation fee is 50% of the flight price, for each person cancelling.
  • Less than 48 hours before the meeting time or in the event of a no-show: the cancellation fee is 100% of the flight price, for each person cancelling or not present.

 
The late arrival of the customer or their early departure does not entitle them to a refund. Additional costs resulting from late arrival, early departure or postponement of the activity are the responsibility of the customer.
 
 
5. Cancellation or modification of the service by the organizer
The organizer reserves the right to cancel or modify the service at any time for reasons of safety or bad weather.
The activity can be cancelled by the organizer if the conduct, or failure to act by the participants justifies it. In this case, the provisions concerning cancellation costs mentioned in point 4 come into force.
 
 
6. Conditions of participation
Good health is a prerequisite for all activities. Participants undertake to inform the organizer of any health problems. Under no circumstances should participants be under the influence of drugs, alcohol, psychotropic drugs or the like.
The participant agrees to meet the conditions of participation and to follow scrupulously the instructions of the organizer and the pilots. The organizer can exclude a participant from the activity if they do not meet the conditions for participation or do not follow the instructions. In this case, the provisions concerning cancellation costs mentioned in point 4. come into force.
 
 
7. Insurance
Participants are not insured by the organizer. Each participant is required to take out sufficient health and accident insurance cover (including sports accidents) themselves. The participants’ accident insurance must cover unlimited medical costs in the territory of Switzerland. Cancellation insurance is recommended.
 
7.1. Insurance for the process of acquiring a paragliding license
Each individual participating in the activities required to acquire a paragliding license must have accident insurance that covers them in Switzerland for the activity of paragliding. In Switzerland, this activity is not considered a risky sport. During paragliding only, damage caused to others is the liability of the organiser. In the event of material damage caused to the sail, the harness or to loaned or rented equipment, this is the responsibility of the participant.
 
8. Gift vouchers
Ordering a gift voucher by the customer and / or user implies acceptance of these general conditions.
The gift voucher is valid for 2 years from the date of issue of the voucher. It can be extended to a maximum of 5 years from the date of issue, after this period the voucher is considered expired.
In the event of an increase in the price of the activity during the extension, the user of the gift voucher will have to pay the difference of the price increase.
 
 
9. Complaints
If the customer has a reason for complaint or has suffered damage, they are required to report it immediately in writing to the activity manager and / or the service provider and to ask them for confirmation. However, the activity manager and / or the service provider is not authorized to acknowledge the claims, so any confirmation received does not constitute an admission of fault. The activity manager and / or the service provider will endeavour to remedy the problem within the bounds of the capabilities of the organisation. If the remedy provided is insufficient or if the problem is not remedied or if the customer wishes to assert claims for damages, these requests must be communicated in writing to the reservation department, for the attention of the organizer, within 4 weeks after the contractual end of the activity. Confirmation from the person responsible for the activity and / or the service provider as well as any evidence must be attached to the complaint. In the event of delay or failure to communicate the complaint during the activity or late filing of the claim with the reservation service, all rights are forfeited.
 
 
10. Liability
Claims for damages against the organizer or their auxiliaries are excluded to the extent that the damage does not result from premeditation or serious misconduct. The organizer is entitled to call on auxiliaries / third parties to perform the service. If the organizer legitimately entrusts the service to a third party, the organizer cannot be held responsible for the acts or omissions of the latter. The organizer is not liable in particular for damages resulting from acts and omissions of the person responsible for the activity, which have no connection with the provision of services agreed in the contract, due to acts of third parties, of other participants, of the participant themselves (in particular what is mentioned in point 1), in case of force majeure, natural events, injunctions from the authorities etc.

The fact that a participant does not obey the instructions of the organizer, the person in charge of the activity etc. excludes all liability of the organizer.

The organizer may not be able to provide the activity through their own organisation, therefore the customer may ultimately do the activity with another provider. The organizer collaborates with quality service providers, however the organizer declines all responsibility and is not a contracting party for any disputes or accidents occurring between the client and the service provider, even if the reservation and payment have been made to the organizer.

For bodily injury, the responsibility of the pilot and / or the contractual partner is limited to their own insurance coverage and direct damage. For damage to materials, the responsibility of the pilot and / or the contractual partner is limited to the price of the service to the injured party.

 
 
11. Image rights
During the service, the organizer may take photos and / or videos for later use in the context of its website, brochures, posters, on the web or on social networks. If, however, the customer does not wish to appear in our photos / videos, they must formally inform the organizer before the end of the activity at the latest.
 
 
12. Applicable law and court of jurisdiction

Only Swiss law is applicable to the contractual relationship between the customer and the organizer. The relevant legal provisions apply. The jurisdiction of Vevey is the sole competent court for all disputes relating to this contract.

If a provision of these T & Cs or several of them is / are ineffective or incomplete or becomes so in the future, a valid provision, the effectiveness of which is as close as possible to the ineffective and / or incomplete provision takes the place of the ineffective and / or incomplete provision. The effectiveness of the other provisions is not called into question by the lack of effectiveness and / or the incompleteness of a provision.
